カリフォルニア州ではギグワーク(*)を大きく制限する法律が2020年1月に施行され、ライドヘイリング(**)とそのドライバーであるギグワーカーの将来が危ぶまれる事態となったが、その後11月に行われた住民投票により法律の適用が除外されることとなった。これによりライドヘイリングは引き続き存続できることとなり、そのドライバーも仕事を奪われずに済むこととなったが、同時にこの業界と働き方が抱えているさまざまな問題点が解消される可能性も遠のくこととなり、将来への不安を残すこととなった。さらに新型コロナの影響も不確定性を増す要因になっている。本稿ではカリフォルニア州におけるギグワーカーに関する住民投票の顛末を振り返ることにより、ライドヘイリングとギグワーカーが抱える問題点を浮き彫りにし、コロナ禍で予想される影響も踏まえながら、将来のあり方を探る一助とする。

In January 2020, a new law which posed a significant restriction upon gig work* and put the future of ride-hailing** and its drivers in danger went into effect in California. However, a subsequent ballot initiative in November exempted the industry from the law, which allowed them to continue operating in the state. This exemption also meant that most of the problems associated with ride-hailing and gig workers were kept unsolved, and their future remains uncertain. In addition, the potential impacts of the on-going COVID-19 pandemic may contribute to this growing uncertainty.To help readers envision the future of the industry, including taking into account the possible impacts from the pandemic, this report examines the ballot initiative in California, and sheds light on the problems ride-hailing and gig workers are facing.
